1. Acceptance of Terms

Welcome to ONE Cabs. These Terms of Service ("Terms") govern your use of our cab booking services, website, and WhatsApp booking platform. By accessing or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of such changes.

2. Service Description

ONE Cabs provides cab booking and transportation services across Assam and nearby regions. Our services include:

• Local and outstation cab bookings
• Airport pickup and drop services
• Multi-day tour packages
• Corporate travel solutions

We offer various vehicle options including Sedans, Maruti Suzuki Ertiga, and Toyota Innova, subject to availability.

3. User Eligibility

To use our services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete information during booking
• Have a valid phone number and email address (if applicable)

By using our services, you represent and warrant that you meet these eligibility requirements.

4. Booking Process

4.1 How to Book

You can book a ride through our website by filling out the booking form and confirming via WhatsApp. All bookings are subject to availability.

4.2 Booking Confirmation

A booking is confirmed only when you receive a confirmation message from us via WhatsApp or phone. We reserve the right to accept or decline any booking request.

4.3 Advance Booking

We recommend booking at least 24 hours in advance, especially for outstation trips and during peak seasons. Last-minute bookings are subject to vehicle availability.

4.4 Accurate Information

You are responsible for providing accurate pickup/drop-off locations, contact information, and travel details. Incorrect information may result in service delays or additional charges.

5. Pricing and Payment

5.1 Fare Calculation

Fares are calculated based on:

• Distance traveled (kilometers)
• Vehicle type selected
• Trip duration and waiting time
• Toll charges, parking fees, and state taxes (where applicable)
• Driver allowance for outstation trips

5.2 Payment Methods

We accept the following payment methods:

• Cash payment to the driver
• Online bank transfer / UPI
• Digital wallets (where available)

5.3 Payment Terms

For local trips, payment is due at the end of the ride. For outstation trips, we may require a partial advance payment (typically 20-30%) at the time of booking, with the balance payable upon trip completion.

5.4 Additional Charges

Additional charges may apply for:

• Waiting time beyond the included free time
• Route deviations or extra stops
• Toll fees, parking fees, and inter-state taxes
• Late-night surcharges (if applicable)
• Cleaning fees for vehicle damage or excessive mess

6. Cancellation and Refund Policy

6.1 Customer Cancellation

• Free Cancellation: Cancel up to 12 hours before scheduled pickup for a full refund
• 6-12 Hours Before: 50% cancellation fee applies
• Less than 6 Hours: No refund; full fare charged
• No-Show: Full fare charged if customer is unavailable at pickup location

6.2 ONE Cabs Cancellation

In rare cases where we need to cancel due to unforeseen circumstances (vehicle breakdown, driver unavailability), you will receive a full refund or alternative vehicle arrangement at no extra cost.

6.3 Refund Processing

Approved refunds will be processed within 5-7 business days to the original payment method.

7. Modification of Bookings

You may modify your booking (date, time, pickup location, vehicle type) by contacting us at least 6 hours before the scheduled pickup. Modifications are subject to availability and may incur additional charges if the new booking costs more than the original.

8. User Responsibilities

As a passenger, you agree to:

• Be ready at the pickup location at the scheduled time
• Treat drivers and vehicles with respect
• Not engage in illegal activities or carry prohibited items
• Not smoke, consume alcohol, or use drugs inside the vehicle
• Wear seat belts and follow safety instructions
• Pay for any damage caused to the vehicle during your trip
• Provide accurate passenger count (not exceed vehicle capacity)
• Supervise children and ensure they are properly seated

9. Prohibited Conduct

You may not:

• Harass, threaten, or abuse drivers or staff
• Provide false information or fraudulent payment details
• Use our services for illegal purposes
• Transport dangerous, illegal, or prohibited goods
• Exceed vehicle passenger capacity
• Damage, vandalize, or soil the vehicle
• Attempt to reverse-engineer or misuse our booking system

Violation of these terms may result in immediate termination of service and legal action.

10. Liability and Insurance

10.1 Our Vehicles

All our vehicles are properly insured and maintained according to applicable laws and regulations.

10.2 Limitation of Liability

While we strive to provide safe and reliable service, ONE Cabs shall not be liable for:

• Delays due to traffic, weather, or unforeseen circumstances
• Loss or damage to personal belongings left in the vehicle
• Indirect, incidental, or consequential damages
• Events beyond our reasonable control (force majeure)

10.3 Maximum Liability

Our total liability for any claim arising from our services shall not exceed the fare paid for the specific booking in question.

10.4 Personal Belongings

You are responsible for your personal belongings. We are not liable for lost, stolen, or damaged items. Please check the vehicle before leaving.

11. Intellectual Property

All content on our website, including logos, text, graphics, and software, is the property of ONE Cabs and protected by copyright and trademark laws. You may not copy, reproduce, or distribute our content without written permission.

12. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

13. Dispute Resolution

In the event of any dispute, we encourage you to contact us first to resolve the matter amicably. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction.

14. Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice, for conduct that violates these Terms or is harmful to other users, drivers, or our business interests.

15. Indemnification

You agree to indemnify and hold harmless ONE Cabs, its owners, employees, and drivers from any claims, damages, losses, or expenses arising from your violation of these Terms or misuse of our services.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ONE Cabs regarding the use of our services.
